WWHGD Triumphs in Miami Arbitration

Weinberg Wheeler Hudgins, Gunn & Dial successfully defended client Arquitectonica in a three-week arbitration in Miami. Partners David Dial, Ross Ginsberg and Scott Witzigreuter represented WWHGD’s architecture design client against claims arising out of the construction of the former Regent South Beach Hotel. The claim was brought against Arquitectonica by the developer, South Beach Resort Development, LLC.

The developers contended that construction cost overruns, delays and lost profits totaling at least $13 million were the responsibility of the design team led by Arquitectonica.

WWHGD was hired approximately six weeks prior to the start of arbitration. The developer never reduced its demand below policy limits. The arbitrators issued an award of $232,000 to South Beach Beach Resort Development, LLC, an amount less than the last offer made by Arquitectonica and Lexington Insurance.

“The firm proved again that we are able to come into a case at the very end and still manage to have successful results,” said partner, David Dial.
