Vaporizing Liability: Strategies for Electronic Cigarette and Vape Companies
In an article published by the Daily Report, Weinberg Wheeler Hudgins Gunn & Dial partner Shubhra Mashelkar and associate Melissa Roque provide insight into the precarious nature of the issues surrounding e-cigarette use and strategic options companies must consider to thwart continued problems and minimize risk.
Mashelkar and Roque emphasized that “across the United States, individual lawsuits and class action lawsuits are being filed at a rapid rate,” noting that many of these lawsuits center around marketing tactics and allege severe personal injury and even wrongful death.
“Companies selling e-cigarettes or vapes — even companies that do not sell THC-based cartridges — can help protect themselves from liability by using adequate warnings,” said Mashelkar and Roque, adding that products should include specific instructions and warnings that only certain approved cartridges may be used with the product.
