Mashelkar emphasized that “across the United States, individual lawsuits and class action lawsuits are being filed at a rapid rate,” noting that many of these lawsuits center around marketing tactics and allege severe personal injury and even wrongful death.
“Companies selling e-cigarettes or vapes — even companies that do not sell THC-based cartridges — can help protect themselves from liability by using adequate warnings,” said Mashelkar, adding that products should include specific instructions and warnings that only certain approved cartridges may be used with the product.
