Florida Court Grants Summary Judgment in Favor of WWHGD Client in Premises Liability Case

WWHGD obtained final summary judgment in favor of our client AEG Presents, a leading live-entertainment company. This case involved a trip-and-fall at an outdoor musical festival, hosted at the Central Florida Fairgrounds in Orlando, Florida. The Plaintiff was in a backstage area when he tripped over a rope suffering personal injuries. He claimed significant damages and his initial demand was well over $400,000. AEG was the promoter and producer of the event. After taking the Plaintiff’s deposition, AEG moved for summary judgment arguing (1) it owed no duty to Plaintiff since it did not own or maintain the premises or backstage area; (2) Plaintiff was trespassing at the time he fell because he was attempting to access a restricted backstage area; and (3) there was no notice of any dangerous condition required to support the Plaintiff’s claims. The Co-Defendant joined in AEG's Motion. The Court agreed with all of WWHGD’s arguments and entered summary judgment in favor of both Defendants on all of Plaintiff’s claims. The Plaintiff previously rejected a statutory proposal for settlement, which will entitle WWHGD’s client to recover its attorneys’ fees and costs in defending the lawsuit.
