Supreme Court Considers Legality of Biden’s Employer Vaccination Mandates

In a Forbes article analyzing oral arguments heard before the U.S. Supreme Court on Friday, January 7, about whether to impose a stay on the Biden Administration’s vaccine mandate for businesses with 100 or more employees, Weinberg Wheeler Hudgins Gunn & Dial Partner Matt Gomes acknowledged the difficulty of the task at hand: “I think that all of the justices acknowledge that this is a difficult situation. They are all aware of the grave threat to public health.”

In the article, Gomes said, politics aside, “Even the conservative Justice Alito acknowledged vaccination is the best way to combat the pandemic,” but the question of whether a mandate should be imposed to encourage inoculation was less clear. “They struggled with the question whether this Emergency Temporary Standard is the best way to accomplish the goal of incentivizing people to get vaccinated,” he said.
