DOJ Challenges Florida Law Restricting Foreign Ownership of Land as Unconstitutional

In an article published July 27, 2023 in Law.com’s Daily Business Review, Jose Herrera-Paez analyzes the recent DOJ decision to challenge Florida’s laws restricting foreign ownership of land and discusses the consequences it could have on investment in the state.

“At the core of the challenge lies the question of federal authority over immigration and foreign relations,” said Hererra-Paez. “The DOJ contends that the regulation of foreign land ownership falls within the purview of the federal government due to its close connection to issues of national sovereignty and international relations. The federal government possesses the power to control and regulate immigration, citizenship and foreign affairs, rendering any state law that interferes with this authority potentially unconstitutional.”
