“Credit Unions Face Website Accessibility Claims Under ADA.”

In an article published on March 29, 2018, in Law360, Nancy Rigby, partner of counsel with Weinberg Wheeler Hudgins Gunn & Dial in its Atlanta office, provides guidance on how credit unions are facing litigation alleging that their websites are inaccessible to blind or low-vision plaintiffs, allegedly in violation of the Americans With Disabilities Act (ADA). Rigby explains how websites are not among the 12 categories specifically identified in the ADA as “places of public accommodations,” and how plaintiffs are consistently alleging that despite the absence of Department of Justice (DOJ) regulations applicable to website accessibility, the DOJ has made its position clear in the past that the ADA applies to websites where business is conducted. She also writes that recent legal filings suggest that the hospitality industry is the next one to be targeted by this type of litigation, and some believe that accessibility claims regarding mobile applications are not far behind.
