"Natural Gas Bans, Bans on Bans, and the Ninth Circuit."

Gary Toman joined Tom Hagy, host of the Law Street Media Emerging Litigation Podcast, to discuss the Berkeley natural gas ban case and attempts by other states to ban natural gas.

“It definitely has an effect on businesses where other governmental entities are trying to do this same sort of direct regulation of the availability of gas and hence gas appliances,” said Toman. “There have been a number (of cases) elsewhere in California, the state of Washington, the state of New York, and some other places, and it's direct regulation where you say it’s not allowed to have gas in new construction and (the proposed ban) is just going to run afoul of this.”
