Vegas Court Grants Summary Judgment in $2M+ Construction Defect Claim
DR Horton contracted to have BFS perform the concrete foundation, framing and stucco on approximately 40 single family homes in Las Vegas in the Buffalo Ranch Community. Years after construction was completed, homeowners began to complain about cracks in the concrete and stucco of their homes, among other issues, and brought suit against DR Horton, seeking millions in cost of repair damages. DR Horton, in turn, brought claims against BFS, seeking to pass on the majority of the cost of repair to BFS. During discovery BFS’s attorneys learned that DR Horton had built the community on top of a massive former quarry and had received warning from its own geotechnical engineer about the risks of doing so. During DR Horton’s corporate representative deposition, it was forced to admit that it had no evidence to tie BFS’s work to the defects in the at-issue homes, ultimately resulting in the Court granting summary judgment in BFS’s favor. The Court recently denied DR Horton’s motion for reconsideration, finalizing this outright win in BFS’s favor. BFS’s defense was led by Colby Balkenbush, Brittany Llewellyn and Sebastian Cribari.
