Defense Team Secures Verdict Assigning Plaintiff 75% Fault in Florida Premises Liability Trial.
WWHGD attorneys Lawrence Burkhalter and Nicole Oña secured a favorable jury verdict for our long-standing client in a premises liability case in Miami-Dade County, Florida. The plaintiff alleged that she sustained shoulder injuries after tripping and falling on a sidewalk maintained by the client and sought approximately $750k in damages.
The defense presented evidence that the plaintiff had an extensive medical history involving similar injuries that pre-dated the incident. After a four-day trial, the jury awarded $38k in damages and found the plaintiff 75% negligent, limiting our client's responsibility to a small fraction of the amount sought.
