This case arose from the collapse of a large retaining wall that rendered a significant portion of a Texas state highway impassable. Our client, Stantec Consulting Services Inc., sued the design-builder for the cost of redesigning the wall. The design-builder counterclaimed for costs associated with rebuilding the wall which it contended amounted to $32 million including interest and attorneys fees. After a five-day arbitration, conducted by the American Arbitration Association in Houston, the arbitrators awarded Stantec its total claimed damages plus interest and denied the entirety of the design-builder’s claim.
