Defense Verdict in Case Alleging Negligence Over Apartment Complex
WWHGD trial team of Jackson “Jad” Dial achieved a defense verdict for our client in Fulton County State Court. This case arose from a July 4, 2017 incident in which a 10 year old boy tragically died in an accidental shooting while playing with other children at a neighbor’s apartment in the Rolling Bends complex in Atlanta, Georgia. The plaintiff alleged that the property management company was liable due to a history of gun related incidents at the complex.
After a 6-day trial and jury deliberation, the jury returned a defense verdict, finding that the prior history of violence at the property was not causally connected to the shooting. Notably, the plaintiff’s last demand before trial was $26 million, with closing arguments requesting between $52 million and $100 million. The defense successfully focused the jury on the relevant facts of the case, leading to a favorable outcome.
