Defense Team Secures Verdict Assigning Plaintiff 75% Fault in Florida Premises Liability Trial.
WWHGD attorneys Lawrence Burkhalter and Nicole Oña secured a favorable jury verdict in a premises liability action tried in the 11th Judicial Circuit Court in and for Miami-Dade County, Florida.
The plaintiff alleged that she sustained shoulder injuries after tripping and falling on a sidewalk maintained by the client. She sought approximately $750k in damages and claimed the incident caused significant injuries requiring compensation.
WWHGD defense team presented evidence that the plaintiff had an extensive medical history involving similar shoulder-related conditions that pre-dated the incident. Following a four-day trial, the jury returned a verdict finding the plaintiff 75% negligent and awarded total damages of $38k. As a result of the jury's allocation of fault, the client's responsibility was limited to a small fraction of the damages sought.
The verdict represented a significant reduction from the amount requested by the plaintiff and delivered a favorable outcome for the client.
