"Who is Liable in an Autonomous Truck Crash? The New Legal Frontier"
WWHGD attorney Diego Rosette was featured in Commercial Carrier Journal's video series to speak with host Jason Cannon about how the liability ecosystem for truck crashes is rapidly expanding as autonomous technology plays a larger role in vehicle operations. Rosette spoke about a case involving Tesla as an original equipment manufacturer (OEM) that could indicate how these types of accidents could play out in court. Tesla was found partially liable in late 2025 for a crash in South Florida.
"The reason the case was so significant is because Tesla was brought in as an OEM... there was a mismatch between what was being marketed or claimed to be the capacity of these autopilot tools and what it could actually do — and that over-reliance contributed to the accident. Ultimately, the jury apportioned 33% of the fault to Tesla... it was a 200-plus million-dollar verdict... in punitive damages," Rosette said.
