Summary Judgment Win in $4M Premises Liability Case.

WWHGD attorneys Jeremy Alberts and Brittany Llewellyn obtained summary judgment in a premises liability case in Clark County where Plaintiff sought more than $4,000,000 in damages.  Plaintiff contended that he was injured as a result of a hazardous condition on the client’s premises. WWHGD argued, and the Court agreed, that Plaintiff offered no admissible evidence establishing that Defendant had actual or constructive notice of a dangerous condition prior to the fall. The Court granted summary judgment, finding that Plaintiff did not meet his burden of producing admissible evidence showing that Defendant breached a duty owed to him. The Court also denied Plaintiff’s motion for sanctions seeking to strike the client’s answer to liability.
