Summary Judgment Secured in Products Liability Case Involving Career-Ending Injury Claim.

WWHGD attorney’s Claire Murray and Patrick Moore were granted a motion for summary judgment in a products liability case in the U.S. District Court for the Southern District of Georgia. The plaintiff alleged that a defect in the product caused an incident in which he sustained a laceration and fracture to his finger. The plaintiff, a highly recruited baseball pitcher, claimed the injury to his pitching finger derailed his potential MLB career. In a 45-page order, Judge Hall granted Moore and Murray’s Daubert motion limiting the opinions of the plaintiff’s metallurgical expert and denied the plaintiff’s motion to exclude our metallurgical expert. The court then entered summary judgment in favor of the defense.
