Defense Verdict in Gas Can Explosion Case
Estate of James Wurster v. The Plastics Group, Inc. d/b/a Wedco Moulded Products
Type of case
Product Liability and Wrongful Death
The Estate of the decedent claimed that the lack of a flame arrestor in all openings of the gasoline container caused an explosion when the decedent poured gasoline out of the container onto a fire. The decedent suffered third degree burns over 80% of his body and passed away hours later. During an 8 day trial, the defendant denied the Estate's allegations, arguing that the subject container met all governmental, industry and scientific standards at the time it was designed and manufactured. During closing arguments the Estate requested $17.5M in damages. After more than a day and a half of deliberations, the jury handed a complete defense verdict to WWHGD's client.
