Plaintiff's Chevy Blazer spun out on wet conditions while merging onto I-285N.   Plaintiff's vehicle crossed several lanes of traffic and collided head on with Defendant’s tractor trailer after the Defendant truck driver attempted to slow down and swerve left.  Plaintiff sustained serious injuries and his passenger was killed.  Plaintiff alleged Defendant driver was speeding, traveling in the #2 lane (prohibited for 18-wheelers) and was fatigued.  During trial, both Plaintiff and Plaintiff's expert witnesses acknowledged that the accident would not have happened but for Plaintiff’s loss of control, regardless of the truck’s speed.  Plaintiff requested $3.5 million in damages.  The Court granted Defendant CRST's motion for directed verdict on Plaintiff's claims for attorney's fees and past and future lost wages.
