Favorable settlement for APC on day of closing arguments

Appalachian Pipeline Contractors, LLP (“APC”) entered into a contract with MarkWest Energy Partners and affiliates (“MarkWest”) in connection with pipeline work performed in and around Harrison County, Ohio.  APC installed 3 separate pipelines of varying diameter at the request of MarkWest in a project which was not formally planned resulting in the need for APC to perform work on an ad hoc basis.  APC submitted change requests, some of which were approved and some of which were denied.  After filing suit, discovery was compressed in order to obtain a trial as quickly as possible. 

Prior to the initially scheduled trial date, the Trial Court granted MarkWest’s Motion for Partial Summary Judgment.  Through a combination of motions and appeal, WWHGD was able to convince the Trial Court to reverse its ruling just prior to trial.  Trial lasted nearly a month, which is believed to be the longest jury trial in the history of Harrison County.
