Our Professional Liability Practice Group has a deep, practical knowledge and base of experience in every major recognized profession. We recognize that professional liability litigation cases call for the right combination of legal expertise with a thorough and current understanding of the practices and protocols within a profession.
To that end, WWHGD has represented on behalf of accountants, architects, chiropractors, doctors, dentists, directors and officers, engineers, insurance agents and brokers, lawyers, nurses, oral surgeons, osteopaths, pharmacists, real estate agents and brokers and veterinarians, as well as a spectrum of paraprofessionals such as physicians assistants, paralegals, nurse practitioners and nurses.
Some recent cases of this practice group include:
- Representation of attorneys and law firms in connection with malpractice claims.
- Georgia: Representation of cardiovascular thoracic surgeon in Atlanta in an alleged medical malpractice wrongful death case. A two week trial resulted in a defense verdict.
- Georgia: Representation of cardiovascular surgeon in Atlanta in an alleged medial malpractice case of a plaintiff who was a surgeon that went in for a laparoscopic procedure and was rendered a paraplegic. A two week trial resulted in a defense verdict.
- South Carolina: Successfully represented home health care agency in medical malpractice claim involving the infusion of four days of chemotherapy in one day.
- Defended hospital in case alleging narcotic overdose resulting in profound brain damage and persistent vegetative state. Case resolved favorably after trial began.
- Illinois: Successfully defended pathology lab in a failure to diagnose extensive breast cancer case.
- Negotiated a very favorable settlement on behalf of a CPA firm and its principals against charges of negligence and fraud based on the accountant's alleged recommendation that a veterinarian conduct business as and title real property in the name of a C-Corporation.
- Defended professional engineering firm in matter in which Plaintiff sought approximately $35 million on the breach of contract cause of action and an additional $1.7 million on an indemnity claim. Total damages awarded on breach of contract claim were $91,000 and $975,000 on indemnity claim. The verdict was less than last offer made by Defendant and substantially less than last demand made by Plaintiffs.
- New Hampshire: Defended professional engineering firm in a case where Plaintiff alleged that the specifications for the construction of a municipal landfill were deficient. After nine day trial, jury returned defense verdict on Plaintiff’s claim for over $8 million. United States District Court for the District of New Hampshire.
- Washington: Defended professional engineering firm related to the design of a large retaining wall in Seattle, Washington. The retaining wall failed during a landslide. Plaintiffs brought a suit for property damage and wrongful death. After eight days of trial, client was granted a judgment as a matter of law at the close of Plaintiffs’ evidence.
- Firm partners have collectively tried over 300 medical malpractice cases in Georgia and nationally.
- Defended multiple law firms, both local and nationally, in claims of legal malpractice.
