Alan’s practice focuses on high-stakes litigation involving mass torts, environmental and toxic torts, product liability and commercial disputes. He has served as national trial and coordinating counsel for product and chemical manufacturers and has handled cases across the United States, including in California, Florida, Georgia, Illinois, Iowa, Maryland, Massachusetts, Missouri, New Jersey, and Ohio. National trial and coordinating counsel for flavoring manufacturer in cases involving allegations that exposure to flavoring chemicals caused irreversible lung disease in hundreds of workers and consumers. Received a defense verdict in federal court case in which the plaintiff had a confirmed diagnosis of lung disease. The case was affirmed on appeal by the Eighth Circuit Court of Appeals. Stults v. International Flavors & Fragrances, Inc., 815 F.3d 409 (8th Cir. 2016).
Trial counsel for a vitamin manufacturer in dietary supplement litigation in which it was alleged that excess minerals caused hair loss, nail loss, heart failure and kidney damage in hundreds of consumers. The first case was tried to verdict and resulted in apportioned damages well below the plaintiff’s pre-trial demand; received a favorable global settlement during the second trial.
Represented pharmaceutical manufacturer in catastrophic injury case involving one death and several serious injuries; one case tried to verdict.
Arbitration award of $1.2 million and defense verdict on $3 million counterclaim on behalf of sugar manufacturer in negligent construction case.
Defense verdict for a property management company in a case in which it was alleged the company created a hazardous condition, causing the plaintiff to develop a terminal lung disease; Plaintiff sought more than $70 million in damages.
Summary judgment on behalf of a non-profit entity in case involving claims of civil conspiracy, conversion, and tortious interference with business relations.
