WWHGD Class Action Defense Case Reported in Montana's The Lake County Leader

ATLANTA (August 31, 2015) --- The Lake County Leader reported on a recently settled case WWHGD defended.  The firm represented Montana Power Company (MPC) in defending a class action pending for more than 16 years.  The certified class asserted that MPC negligently operated Kerr Dam on Flathead Lake in Flathead County, Montana.  As a result, the certified class of more than 3,000 property owners around the largest natural fresh water lake west of the Mississippi alleged erosion, violations of easement rights and other damages to their lake-front properties totaling many millions.  The Montana Supreme Court issued 3 different opinions on appeals.  On August 19th, 2015, the trial court granted final approval of the $1.45 million settlement paid by MPC’s insurer.  If each plaintiff/landowner that is part of the class submits a claim, he/she will recover less than $300.
