Todd Ehrenreich Serves as U.S. Counsel in International Trial
Weinberg, Wheeler, Hudgins, Gunn & Dial, LLC partner, Todd Ehrenreich, was U.S. Counsel to Centex Rooney Construction Company, Inc. (“Centex”) in an international trial that received a defense verdict in The Bahamas.
The two week trial stemmed from a fatal injury in 2000 when a guest at the Paradise Island Resort entered an underwater cement intake vault in the resort’s pool. The uncovered vault contained pipes which transported sea water to the resort’s main pump room for circulation to various waterfalls on the resort grounds. When the guest accessed the vault, the water pumps activated and drew the guest into a 14” pipe thus breaking his neck and causing an immediate fatality. The deceased’s estate filed a suit against Kerzner International Limited, the hotel owner, and the claim was settled for $7.5 million.
Kerzner then brought action against Centex and Cloward & Associates, P.C. who were the constructor and designer of the underwater cement intake vault. The claim stated that Centex and Cloward improperly designed the intake vault. Kerzner claimed a breach of contract and breach of duty of care.
A defense verdict was reached in the Supreme Court of the Commonwealth of The Bahamas. The Plaintiff is responsible for the Defendants’ costs to be taxed if not agreed.
